Terms and conditions.

Draft version of the terms and conditions; it will undergo legal review before going live on www.bakom.cz. Until then, the terms stated in our quote and order confirmation apply.

1. Seller

These terms govern the sale of batteries, accessories and other goods to consumers and businesses.

2. Order and conclusion of the contract

• Information on the website (specifications, prices) is for guidance only and does not constitute an offer to conclude a contract.
• Based on your inquiry, we will send you a quote with the price and the expected delivery date. We build batteries to order, so the delivery date is always set individually.
• Joining the order queue (reservation) is free of charge and non-binding. We will confirm the order with you before production starts.
• The contract is concluded when we confirm the order (by e-mail).

3. Price and payment

• Prices on the website are shown excl. VAT unless stated otherwise. The price in the quote and the order confirmation is binding. The shipping cost is stated in the quote.
• We do not ask for deposits on batteries we make. Once production and the final test are complete, we issue an invoice; we ship the battery after the payment reaches our account. For collection in person, payment on site is possible by arrangement.
• Goods from other manufacturers that we order from a distributor (inverters, for example) may be invoiced in advance with an advance invoice. We will always point this out in the quote.

4. Delivery

• Smaller consignments are sent by courier (e.g. PPL), heavier batteries on a pallet (e.g. DHL). We deliver within the Czech Republic and to Slovakia. Delivery to other EU countries is arranged individually for each order.
• Collection in person is possible by arrangement at our workshop in Svrčovec near Klatovy or in Krmelín near Ostrava.
• Lithium batteries are shipped as dangerous goods (UN 3480, ADR class 9). On receipt, please check that the consignment is intact; record any damage on the carrier's document and let us know.
• Ownership of the goods passes to the buyer upon payment of the purchase price; the risk of damage passes upon receipt of the goods.

5. Withdrawal from the contract

A consumer who has concluded a distance contract may withdraw from it without giving a reason within 14 days of receiving the goods. Sending the withdrawal by e-mail is sufficient; the goods must be returned undamaged, switched off and with the terminals covered, and the consumer bears the cost of return. We will refund the money within 14 days of withdrawal, but not before the goods have been returned.

We build batteries to order and configure them according to the customer's details (inverter type, communication, design). Under Section 1837(d) of the Civil Code, a consumer cannot withdraw from a contract for goods customised to their wishes. Whether this applies to your order will be stated in our quote.

6. Defects and warranty

Rights arising from defective performance and the warranty are covered by the Warranty and claims page and the warranty certificate supplied with the battery. The battery cells carry a 4-year warranty.

7. Dispute resolution

Consumers have the right to out-of-court resolution of consumer disputes. The competent body is the Czech Trade Inspection Authority, adr.coi.cz.

8. Final provisions

Rights and obligations not covered by these terms are governed by the Civil Code (Act No. 89/2012 Coll.) and, for consumers, also by the Consumer Protection Act. The processing of personal data is described on the Privacy policy page.
